Commercial Arbitration

Arbitration chosen as a control decision, run as an enforcement exercise.

Handle leads commercial arbitration in the UAE and international seats — from the notice of dispute to the final award and its enforcement — integrating case theory, evidence, tribunal strategy and recovery from the first correspondence.

When this is needed

Commercial arbitration in the UAE: where the mandate begins.

  • A contract with an arbitration clause has been breached, and the counterparty has failed to respond to notices.
  • A shareholder, joint venture, distribution or construction dispute requires confidentiality and an enforceable outcome.
  • Assets must be preserved through emergency arbitrator relief or court support while the arbitration proceeds.
  • An award has been issued and must be recognised and enforced, or defended against a challenge.

Matters Handle leads

Commercial arbitration from notice to recovery.

Four mandate types. One case architecture.

Institutional Arbitration

DIAC, ICC, LCIA and ADGM-administered proceedings.

Ad Hoc Arbitration

Proceedings under bespoke clauses and the UNCITRAL Rules.

Interim & Emergency Relief

Preservation measures from tribunals and UAE courts.

Award Enforcement & Challenge

Recognition, enforcement and set-aside defence.

The scope

Commercial Arbitration — scope, made explicit.

A focused, premium mandate — with an enforceable award at the center.

Pre-Arbitration Strategy

Notices, escalation steps and forum confirmed.

Tribunal Strategy

Nominations and challenges handled deliberately.

Case Architecture

Pleadings, documents, witnesses and experts under one plan.

Court Interface

Interim measures and supervisory applications coordinated.

Post-Award Execution

Recognition, enforcement or challenge across forums.

The mandate

An award is worth what can be collected.

Commercial arbitration is chosen for confidentiality, tribunal expertise and international enforceability — but those advantages are realised only if the seat, rules, relief and evidence are planned with the counterparty’s assets in view. Handle maps enforcement first and builds the case backwards from it.

UAE-seated arbitrations are governed by Federal Law No. 6 of 2018, with the DIFC and ADGM Courts supervising arbitrations seated in their jurisdictions, and the New York Convention carrying awards abroad. Handle coordinates the tribunal and the relevant court as one environment, and instructs local counsel where enforcement is pursued outside the UAE.

What the mandate delivers

  • Seat, rules and tribunal strategy
  • Pleadings, evidence and expert management
  • Emergency arbitrator and court-supported interim relief
  • Hearing preparation and advocacy
  • Post-award applications and challenge defence
  • Recognition and enforcement planning

The matter may begin here — it stays connected to strategy, capital and law.

Strategy & Operations

The work stays connected to market position, operating model, performance and execution governance.

M&A & Capital

The work stays aware of capital readiness, investor review, transaction logic and deployment discipline where relevant.

Legal & Regulatory

The work stays protected through structure, rights, governance, enforceability and regulatory or dispute readiness.

Why Handle

Forum controlled. Award executed.

Arbitration is not merely a forum choice; it is a decision about control. Handle runs each commercial arbitration with the award’s enforcement already planned, so that the result can be executed against real assets.

  • Experience across DIAC, ICC, LCIA and ADGM rules
  • Seat chosen for supervisory court quality
  • Document and expert discipline
  • Interim relief planned from day one
  • Settlement assessed at each milestone
  • Board-ready reporting on risk and cost

Good litigation is disciplined project management. Clear filings, clean evidence, and a hearing plan that your board understands. That is how outcomes travel from courtroom to cash.

How Handle approaches commercial arbitration in the UAE.

When confidentiality, tribunal expertise and enforcement across borders matter more than the familiarity of a local court.

Federal Law No. 6 of 2018 on Arbitration governs onshore-seated arbitrations; the DIFC and ADGM have their own arbitration laws and regulations.

DIAC is the principal Dubai institution, operating under its 2022 Rules, alongside the ICC, the LCIA and arbitration administered in ADGM.

By the method in the arbitration clause or institutional rules. Handle assesses candidates for sector knowledge, procedural approach and independence.

Yes. Emergency arbitrator relief, tribunal orders and supporting applications to UAE, DIFC or ADGM courts may be available.

The UAE is a party to the New York Convention, so awards can be enforced in other contracting states, subject to limited grounds for refusal.

Only on limited grounds, typically procedural or jurisdictional, before the courts of the seat. Handle defends and assesses challenges accordingly.

Its validity and scope are assessed first; the strategy may involve compelling arbitration, resisting court jurisdiction or agreeing a corrected procedure.

Yes, and agreed terms can be recorded in a consent award so that they are enforceable like any other award.
