Enforcement Of International Arbitration Awards

International awards converted into collected value in the UAE and beyond.

Handle leads the enforcement of international arbitration awards against assets in the UAE and abroad — testing each award against the grounds for refusal, choosing between onshore, DIFC and ADGM routes, and coordinating local counsel wherever assets sit outside the UAE.

When this is needed

Enforcement of international arbitration awards: where the mandate begins.

  • A final award has been issued, and the debtor has not paid.
  • The debtor holds bank accounts, shares, receivables or real estate in the UAE.
  • The debtor has started set-aside proceedings at the seat to delay enforcement.
  • Assets are spread across several jurisdictions, and recognition must be sequenced.

Matters Handle leads

Enforcement campaigns built around assets.

Four enforcement workstreams. One recovery line.

UAE Recognition Proceedings

Foreign awards recognised before the competent UAE court.

Asset Tracing & Precautionary Attachment

Assets located and secured before execution.

Resisting Debtor Challenges

Objections and set-aside tactics answered.

Multi-Jurisdiction Recovery

Foreign enforcement directed through local counsel.

The scope

Enforcement Of International Arbitration Awards — scope, made explicit.

A focused, premium mandate — with collected value at the center.

Enforceability Review

Award tested against refusal grounds before filing.

Forum Choice

Onshore, DIFC or ADGM route selected on assets.

Execution Measures

Accounts, shares and property attached and realised.

Sovereign & State-Linked Debtors

Immunity and commercial assets assessed.

Settlement Under Pressure

Payment plans and security negotiated from strength.

The mandate

An award is a right. Enforcement makes it money.

The UAE acceded to the New York Convention in 2006, and recognition of foreign awards is sought before the competent UAE court, with refusal limited to defined grounds such as incapacity, lack of proper notice, excess of jurisdiction or public policy. Preparing the file properly — authenticated award, arbitration agreement and translations — avoids avoidable delay.

Handle builds the enforcement plan from the asset map outward: which assets are reachable, which court gives the most effective route, and in which order foreign recognition should be pursued through local counsel. Interim protection is sought early where the debtor may move value.

What the mandate delivers

  • Enforceability and risk assessment
  • Recognition proceedings in the UAE
  • Asset tracing and precautionary attachment
  • Execution against UAE assets
  • Coordination of foreign enforcement counsel
  • Settlement and payment structuring

How the work runs

Four disciplines. One recovery.

Every enforcement mandate is run with asset intelligence, forum selection, procedural precision and execution pressure.

01

Asset Intelligence

Reachable assets identified before filing.

02

Forum Selection

Court chosen for speed and asset reach.

03

Procedural Precision

Filings complete, translated and authenticated.

04

Execution Pressure

Attachment and sale pursued to collection.

The Handle model

Practice-led. Never fragmented.

The matter may begin here — it stays connected to strategy, capital and law.

Strategy & Operations

The work stays connected to market position, operating model, performance and execution governance.

M&A & Capital

The work stays aware of capital readiness, investor review, transaction logic and deployment discipline where relevant.

Legal & Regulatory

The work stays protected through structure, rights, governance, enforceability and regulatory or dispute readiness.

Why Handle

Awards collected, not just recognised.

Recognition is a step, not the outcome — Handle measures enforcement by what is collected, and plans every filing around the assets that can be reached.

  • Onshore, DIFC and ADGM enforcement routes
  • Asset-led enforcement planning
  • Debtor challenge and set-aside strategy
  • Sovereign and state-linked debtor experience
  • Foreign counsel directed from the UAE
  • Settlement pressure from credible execution

Good litigation is disciplined project management. Clear filings, clean evidence, and a hearing plan that your board understands. That is how outcomes travel from courtroom to cash.

Questions, answered

Enforcement Of International Arbitration Awards — questions, answered.

How Handle approaches the enforcement of international arbitration awards.

Yes. The UAE is a party to the New York Convention, and foreign awards can be recognised by the competent UAE court subject to limited grounds for refusal.

The grounds are limited and include incapacity or an invalid agreement, lack of proper notice, excess of jurisdiction, improper composition and public policy.

The choice depends on where the assets are, the debtor’s profile and the jurisdictional basis available; Handle assesses each route before filing.

Typically the original or certified award and arbitration agreement, with certified translations into Arabic where required by the court.

Precautionary measures may be available where there is a risk of dissipation, subject to the court’s requirements.

The enforcing court may adjourn or proceed depending on the circumstances, and security may be sought in the meantime.

Yes in principle, but immunity from execution protects certain state assets, so commercially used assets are identified first.

Handle directs the strategy and instructs local counsel, who bring the proceedings in each foreign court.

Before the final award issues, so assets are mapped and protective steps are ready when the award arrives.
